General Terms and Conditions for the execution of open seminars, workshops, group training, and other events organized by imbus Canada Corporation.
General information:
These “General terms and conditions for the execution of open seminars, workshops, group training courses and other events at the imbus Academy” are binding for contracts with the companies’ imbus Canada Corporation, Toronto, Ontario – henceforth referred to as imbus Canada.
imbus Canada uses the event areas according to the policy of the lease contract agreed upon with the property owner. All participant(s) at the free or paid events should abide by the underlying general terms and conditions for the events, as well as the conditions of the property owner. The latter should be available on request to the organizer by the property owner. With registration and participation for the events, you agree to accept these General Terms and Conditions for Events.*
Registration:
Registration can be submitted in a written form via postal mail, e-mail or online form submission. The organizer will assume that the undersigned person is entitled to register, based on the data submitted during the registration. The organizer is not obliged to explicitly check the legal validity of the signature.
The acceptance of the participant(s) registration by imbus Canada is only binding when it has been confirmed by imbus Canada in a written form. The confirmation can also be given by telefax or e-mail. The decision on whether to accept the registrations of participant(s) is exclusively made by imbus Canada. An entitlement to the participation does not exist.*
Prices and Price Changes:
All prices are per person in Canadian $ and do not include the applicable TAX. The invoice will be issued immediately after participation in a training course. If not agreed otherwise, payment of the course fee is due without deductions and within 14 days of receipt of invoice.
Services:
If not stated otherwise during the registration process, participation fees includes cost for the required worksheets and handouts, refreshments during breaks and lunch, as well as the cost of providing the necessary hardware and software and their use during the duration of the course. Expenses incurred as a result of certification exams by a third party, journeys to and from the venue, accommodation, transfers to the venue, and other ancillary services are not included and are listed separately in the bill, if booked via imbus Canada. In such case that the training course includes practical exercises on a PC, PCs will be made available with a maximum of two participant(s) to one PC.*
Variations in the Execution of the Course:
Reception of the course confirmation does not constitute a legal claim that the respective training course will take place at the specified time and place. Training may vary in time and place, the conducting trainer as well as smaller changes in course contents with regard to the training description. Should changes towards the data on your course confirmation become necessary, we will notify you of this immediately.
Delegates disturbing the course of the training considerably may be excluded from further participation in the course. In this case, an administrative fee of 20% of the course cost is raised for the part of the course that has not been visited by the delegate.
Deviations in the performance:
In general, the events are performed in the ways that are stated in the corresponding event description. imbus Canada reserves the right to make changes which are necessary due to updates or upgrades to the events or for organizational reasons.*
Changing or Cancelling a Booking by the participant:
Cancellations are free of charge if we receive it at the latest three weeks before the course begins. Please understand that cancellations at short notice, partial participation or non-participation in the course will be charged in the same way as a full participation. Participant(s) have the right to name in writing a replacement participant(s) up until the training course has begun.
Changing or Cancelling a Booking by imbus Canada:
imbus Canada has the right to cancel the event before or after the completion of the registration and also at the last-minute, if the event is not of interest for imbus Canada due to unforeseeable low participation rate. In the case of such a cancellation from our side, we will reimburse any previously remitted course fees in full. Any further claims by the participant(s) against imbus Canada are excluded. Furthermore, the participant(s) is not entitled to claim a reimbursement for travel and accommodation expenses or non-productive time.*
Copyright of materials:
All of the training worksheets and handouts that are made available are only intended for personal use by the participant. This also applies to any knowledge products and learning systems that have been transferred to the participant(s) on data carriers or via the training network or via Internet access. The rights to these worksheets and handouts and all parts of them, including translations, which are reprinted or copied are retained by imbus Canada (or their licensor). No part of the worksheets and handouts may be reproduced, copied, processed using electronic systems, or distributed by any third party for any purpose without written authorization by imbus Canada.
Any software deployed during the training course must not be copied or removed from the training rooms without written authorization from imbus Canada.*
Video and sound recordings:
imbus Canada is entitled to all photographs, drawings, and video recordings produced during the events and can be used for the purpose of marketing. The participant(s) hereby declares his consent by submitting the registration. The same is true for recordings made by the press and/or television with the consent of imbus Canada. Participant(s) are not entitled to make sound or video recordings of the event or participant(s).*
Events:
All events are prepared and performed with utmost care. This does not guarantee a training success. imbus Canada is not responsible for damages caused by third parties (e.g. exhibitors or participant(s) ). Any liability claims against imbus Canada are excluded where legally permissible.*
Liability of the Participant(s):
To ensure the security of the network, participant(s) are not allowed under any circumstances to deploy any data carriers they have brought with them on imbus Canada computers, or to connect any computers, they have brought with them to the imbus Canada Ethernet. In such case that damage occurs due to contravention of this regulation by the participant, the participant(s) will be liable for the damage.
In the case that damage occurs to hardware or to items of equipment, the participant(s) responsible is liable for this damage.
Liability of the Event Organizer:
Liability claims against imbus Canada are excluded in so far as this is legally permissible. Namely, damages incurred by computer viruses or other malware, are excluded.
Data protection:
Participants who register for an event performed by imbus Canada agrees to provide their personal data. imbus Canada will only use these data within the imbus Canada and its affiliates, such as imbus AG. In the event of any data being passed on to service providers for the purpose of data processing, these will then be subject to the PIPEDA (Personal Information Protection and Electronic Documents Act), other applicable laws and the contractual provisions of the privacy policy of imbus Canada.
The transmission of personal data to state institutions shall be carried out by imbus Canada in the event of a court order or other requests by law.
All personal data that imbus Canada receives upon the participant(s) registration can be removed by imbus Canada upon request by the participant.*
Further regulations:
Subsidiary agreements have to be made in written form. The place of jurisdiction for any disputes arising from this contractual agreement shall be in the province of Ontario where the federal laws of Canada apply.*
